Regulation 20 - Made Plan
Cheshire West and Chester Council decided to make the Utkinton and Cotebrook Neighbourhood Plan under Section 38A(4) of the Planning and Compulsory Purchase Act 2004 on 20 May 2021.
The Utkinton and Cotebrook Neighbourhood Plan now forms part of the Development Plan for Cheshire West and Chester and will be taken into account in local planning decisions. The Council has published a decision statement which sets out the decision to make the neighbourhood plan and the reasons for doing so.
Regulation 19 - Referendum
The Utkinton and Cotebrook NP referendum took place on 6 May 2021, with 90% of voters saying "yes" to the neighbourhood plan.
Regulations 17 and 18 - Examination
Cheshire West and Chester Council appointed Mr Andy Mead BSc (Hons) MRTPI MIQ as independent examiner of the Utkinton and Cotebrook Neighbourhood Plan. His report was published on 9 March 2021.
Mr Mead wrote to the Council and the Qualifying Body (Utkinton and Cotebrook Parish Council) on 14 December 2020 to clarify some initial procedural matters. He wrote a follow up letter on 22 December 2020 with some questions for the Qualifying Body and the Council. The Council and the Qualifying Body replied to Mr Mead in January 2021
Regulation 15 and 16 - Publicity stage consultation and SEA + HRA screening determination
The Utkinton and Cotebrook NP regulation 16 consultation ran from 12 October to 30 November 2020.
Regulation 14 - Pre-submission consultation
The Utkinton and Cotebrook NP regulation 14 consultation took place between 16 October and 4 December 2019.
Regulations 5, 6 and 7 - Neighbourhood Area designation
As a result of a community governance review, the boundary of Utkinton and Cotebrook parish was amended with effect from 1 April 2015, however the maps accompanying the Order were incorrect and required rectification to show the correct boundary. As such the Council made the Cheshire West and Chester Borough Council (Reorganisation of Community Governance) (Utkinton) (Amendment) Order 2018 to rectify this mapping error.
This neighbourhood area application is made to correct the boundary of the neighbourhood area, to ensure that it aligns with the Parish Council boundary change in 2018.
The revised neighbourhood area was designated on 17 October 2019.
